What Records Will I Need If I Have Been In a Motor Vehicle Accident?

Almost every car accident results in some type of damage to your vehicle and/or injuries.  Sometimes, simple accidents with little damage may be handled strictly through insurance companies.  However, many times, especially in more complicated accidents with serious injuries or questions of fault, the other driver’s insurance company may try to get out of fully compensating you for your losses.  In these cases, you may want to bring a claim against the responsible driver in order to fully recover for your injuries and damages.

If you are considering filing a personal injury claim, there are certain records that you will need to gather.  These records include:

Medical Records

Your medical records are a key component of your personal injury claim Therefore, hold on to:

  • Bills from emergency room visits and hospital stays
  • Bills for casts, braces, or other equipment
  • Visits to and treatment from your doctor or specialists
  • Prescription medications
  • Physical therapy and rehabilitative services
  • Any home health care services
  • Other related medical services.

Police Report

This report should include all details of the accident, including your version of events, the accounts of all witnesses, and whether any traffic laws were violated to cause the accident.  The police report can be very important in showing the other driver was at fault in the accident.  To get a copy, contact the law enforcement agency who was on the scene.  If you disagree with any information in the report, you may file for an amendment.

Property Damage Estimate

If your insurance company does not perform its own damage inspection, you may have to get an estimate for repairs from mechanics or body shops.  You may want to get two or three different estimates to ensure accuracy.

Tax returns, pay stubs

If you missed work because of your injuries, you may be entitled to all lost wages.  Therefore, be prepared to show documentation of your usual wages and all time that you missed work.
