How much time do I have to file a workers' comp claim?

You only have a certain amount of time to file your workers’ compensation claim after your injury. If you wait too long, you’ll be unable to make a claim. An injured worker has two (2) years from the date of accident or date of disability to file a claim for compensation.

Who pays for Workers' Compensation benefits?

Insurance companies pay for workers compensation benefits through premiums collected from businesses.

How do I file a Workers' Compensation claim?

  1. Notify the employer of the injury (date, time, type of injury, and how it occurred.)
  2. Hire an attorney to file a claim with the insurance company.
  3. The employer should give the employee:
    • The proper reporting forms for the workers’ compensation insurance provider.
    • A form for reporting to the state workers’ comp board.
    • Information on the employee’s rights and workers’ compensation benefits.
    • Information about returning to work.
  4. Once the claim is properly filed, the insurance company will process it and the right attorney will ensure that your rights to receive medical treatment and lost wages are protected.

What if my workplace injury was my fault?

You are still entitled to benefits even if your work injury was partially or even entirely your fault. Workers’ compensation is a “no-fault” system. That means that you do not have to prove that your employer did anything wrong to get benefits.
